During the course of one particular job, an industrial coating on some locker-room floors, Dave offered to sell me a truck. Understand that he knew from the day I started, that I did not have a license to drive. It seemed Dave could care less if I had a license or otherwise, and pressed me to buy his truck.

Truth be told, I had just spent several thousand dollars moving into this new area where he promised me “loads” of work, and I was still recovering from that loss. I did not have the $$ to buy this truck. Dave was not yet satisfied, mentioning that he would take payroll deductions of my pay. No matter what, he wanted to get rid of that beaten junk and force it into my hands.

After flat out refusing to purchase Dave’s truck, I was punished by not receiving a job assignment for about a week or so.

Then back to work I went.

One day, out of the blue, I receive a cell message from Dave telling me that that particular day was my last day, and that my final check would be in the mail the following day.

I emailed in my hours, and told the office I wanted to come by and get my check, but I never received a reply.

Four days had passed, and still my payroll did not come into my hands. I was beginning to worry a bit.

It was impossible to get a hold of Dave by email, or FAX over 5 or 6 attempts, so I had to leave it at that.

Be that as it may, I filed or my remaining unemployment. Unfortunately, I could not tell the EDD why I was not working, only that I did not quit.

It seems as Dave had told the EDD that I was discharged for misconduct; “I had no drivers license”. Of course the EDD decided in my favor, simply for the fact that not having a license is nowhere near the grounds for dismissal for misconduct.

But that was not enough for Dave. Now he has appealed the EDD decision, and on the coming Wednesday, we have a hearing in front of the judge.

I’m not to worried about any of this, as I’m very aware of the law in this respect. In fact I’m very grateful to Dave for doing this.

He does not know it yet, but this is just the beginning of many hardships he will have to endure over messing around with my world.

Why don't you get a lawyer, and sue for wrongful termination, and harassment?
